§ 2-222. Penalties; fees; costs; judgment.

  • (a)

    In determining the amount of the civil penalty to be imposed for any violation of a code provision or ordinance, the court may judicially recognize copies of the Code of Ordinances or any ordinance, certified by the city clerk as being a true and correct copy of the original ordinance on file in the city clerk's office, effective as of the date of the alleged violation.

    (b)

    The penalties provided herein are applicable only to enforcement pursuant to the supplemental code enforcement procedures set out herein. The penalties shall be as follows:

    (1)

    Uncontested citations.

    a.

    Each first violation: Up to $250.00.

    b.

    Each subsequent violation: Up to $500.00.

    (2)

    Contested citations.

    a.

    Each first violation: Up to $350.00.

    b.

    Each subsequent violation: Up to $500.00.

    (c)

    A person, corporation, or entity found in violation hereunder shall be liable for court costs and the city's attorney's fees as determined by the court. The penalty, court costs and city's attorney's fees, as determined by the court, shall be evidenced by a recordable judgment.
